General Terms and Conditions (GTC's) -box5

1. Validity of the General Terms and Conditions
The following general terms and conditions of contract and business of box5 apply to all legal transactions or actions similar to legal transactions. The contract for membership comes about through the mutual signing of the membership agreement. Members are persons who are entitled to use the box5 based on a membership agreement that has been concluded. The Member's rights under this Agreement are not transferable.
2. Written Termination of Contract
The notice period is 56 days for a contract term of 12 months and 28 days before the end of the contract for a contract term of 1 month. If the contract is not terminated, it will be extended by the contract period that has already been concluded. The termination must be in writing. The agreement can be interrupted by mutual consent for a period of time (weekly) to be determined in advance in the event of proven illness, pregnancy, military service or comparable reasons for being unable to attend. The fixed term (the ordinary termination option and the agreed notice period) is postponed by the duration of the agreed interruption period. In the event of a permanent impossibility, in particular due to a permanent illness, which finally excludes use, the member is entitled to terminate the contract for good cause. This must be proven in writing.
3. Physical Requirements
The member undertakes to inform the trainers or other employees of the studio of any health restrictions that could endanger the member's health when using the studio.
4. Membership Fee / Direct Debit Authorization
The contributions selected in the membership agreement are debited in advance on the 1st of the respective month. The membership fee will be collected by direct debit. If the participant does not meet the payment obligation in good time, box5 is entitled to terminate the contract without notice if the participant is in arrears with the payment of more than one monthly contribution or transfers three times in a row after the third day of the week.
5. Application of the house rules
When using the facility in the box, the member must observe the house rules posted in the box. The member is also obliged to follow the instructions of the Box employees to enforce the house rules. If the member repeatedly fails to follow the instructions and/or violates the house rules, box5 is entitled to terminate the contract without notice for good cause.
6. Registration / cancellation of training sessions
All members must register for the training sessions via Team Up. If the booked appointment cannot be kept, a cancellation must be made via Team up.
7. Minimum number of participants for classes
The training sessions always take place from Monday to Friday with a minimum of 3 participants. In the event that only 2 or fewer members are registered for a training session, this training session may be cancelled. Members registered for this training session do not lose the right to this training session and can register for another training session as compensation.
8. Personal Items
box5 provides shelves in which personal items, especially clothing, can be stored. However, the member is advised that criminal offenses, in particular burglary, cannot be ruled out as a result. We therefore ask that you do not bring any valuables into the studio or place them in the lockers provided. box5 assumes no liability for the loss of or damage to these items or clothing.
9.Liability
box5 is only liable for the breach of essential contractual obligations (cardinal obligations) in accordance with the statutory provisions. If there is still liability for negligence, the obligation to pay compensation is limited to damage resulting from the breach of essential contractual obligations. Significant contractual obligations are those whose fulfillment enables the proper execution of the contract in the first place and on whose observance the member can regularly rely. In particular, the ongoing provision of the training services described in the membership contract is an essential contractual obligation. Unless otherwise stipulated above, liability for damages and reimbursement of expenses - for whatever legal reason, in particular from breach of duty, tort and culpa in contrahendo is excluded. The member is liable for self-inflicted accidents. box5 is not liable for injuries and damage caused to the customer by other customers or third parties. The ongoing monitoring of his state of health is the responsibility of the member. Injuries and illnesses that the member suffers while using the equipment and facilities of box5 are the responsibility of the member, unless an intentional or grossly negligent violation of essential contractual obligations by box5 is the cause. This applies in particular if damage is due to a misjudgment of one's own physical resilience or accidents that are self-inflicted.
10. Change of Member Information
The member is obligated to notify box5 of any change of address, name or account details. Any additional costs incurred as a result of omission shall be borne by the member.
11. Privacy
The personal and training-related data of the member are collected, stored, processed and used by box5 as part of one of the box5 data processing programs. However, this is done exclusively for the purpose of fulfilling the contract and to the extent permitted by law. The data will not be passed on. 12. Severability Clause
Should individual provisions of this contract prove to be wholly or partially invalid or unenforceable or become invalid or unenforceable as a result of changes in legislation after the conclusion of the contract, the remaining contractual provisions and the effectiveness of the contract as a whole remain unaffected.
